01 Agreement to Terms
By downloading, installing, or using the Tanly iOS application or visiting tanly.co (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Service.
These Terms constitute a legally binding agreement between you and Tanly ("we," "our," or "us"). Please read them carefully.
By using Tanly, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.
02 Eligibility
You must be at least 13 years old to use Tanly. If you are between 13 and 18 years old, you may only use Tanly with the consent and supervision of a parent or legal guardian.
By using the Service, you represent and warrant that you meet these eligibility requirements.
03 Accounts
To access Tanly's core features, you must create an account. Your account is managed and authenticated through Supabase. When creating your account, you agree to:
- Provide a valid email address and accurate account information
- Maintain the security of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately at support@tanly.co if you suspect unauthorized access
- Not share your account credentials with others
- Not create multiple accounts to circumvent restrictions or access free trials repeatedly
We reserve the right to suspend or terminate accounts that violate these Terms at our sole discretion.
04 Acceptable Use
Tanly grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes, subject to these Terms.
You agree to use Tanly only for its intended purpose — tracking personal tanning sessions, monitoring UV exposure, and building healthier tanning habits — and in compliance with all applicable laws.
05 Subscriptions & Billing
Tanly may offer premium features through in-app subscriptions. All subscriptions are managed through RevenueCat and processed via Apple App Store Connect.
Subscription Terms
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date
- Payment is charged to your Apple ID account at confirmation of purchase
- You can manage and cancel your subscription at any time via your Apple ID account settings or the App Store
- Cancelling a subscription does not provide a refund for the current billing period — you retain access to premium features until the end of the paid period
- Free trials, if offered, automatically convert to a paid subscription unless cancelled before the trial ends
Refunds
All purchases are final and non-refundable except where required by applicable law. Refund requests must be directed to Apple through their standard refund process at reportaproblem.apple.com. We do not process refunds directly.
Price Changes
We reserve the right to change subscription pricing at any time. You will be notified of price changes before they take effect, and continued use of the Service constitutes acceptance of the new pricing.
06 Health Disclaimer
Tanly is a personal tanning session tracker designed to help you build safer habits. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
- The Skin Health Score is an informational metric based on your logged habits — it is not a clinical assessment
- UV Index readings and tanning tips are general recommendations and may not account for individual skin type, medications, or health conditions
- Tanly's safety guidelines (e.g., SPF recommendations, session limits) are general wellness suggestions, not medical directives
- Always consult a qualified dermatologist or healthcare provider for personal skin health advice
- If you experience skin irritation, burns, or other adverse effects, stop tanning and seek medical attention
Excessive UV exposure is associated with serious health risks including sunburn, premature aging, and increased risk of skin cancer. Use Tanly as a tool to track and moderate your exposure, not to justify overexposure.
07 Intellectual Property
The Tanly app, its design, interface, codebase, branding, logos, trademarks, and all original content are owned by Tanly and protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or create derivative works of the Service
- Reverse engineer, decompile, or attempt to extract source code
- Use Tanly's name, logo, or branding without prior written permission
- Reproduce or distribute the app outside of the Apple App Store
08 User Content
You retain ownership of personal data and notes you enter into Tanly (your "User Content"). By using the Service, you grant Tanly a limited licence to store, process, and display your User Content solely to provide the Service to you.
You represent that your User Content is accurate and that you have the right to submit it. We do not claim ownership of your session data, notes, or personal tanning history.
09 Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any laws
- Attempt to gain unauthorized access to any part of the Service or its systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated bots, scrapers, or other automated tools to access or interact with the Service
- Reverse engineer, decompile, or extract the app's source code
- Create multiple accounts to abuse free trials or circumvent account restrictions
- Impersonate any person or entity
- Introduce malicious code, viruses, or other harmful software
- Use the Service for commercial purposes without written consent from Tanly
10 Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TANLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or always available
- UV index or weather data will be perfectly accurate at all times
- The Skin Health Score represents a medical assessment of any kind
- The Service will meet your specific requirements
UV and weather data is sourced from third-party providers and may occasionally differ from actual conditions. Always exercise personal judgment when making decisions about sun exposure.
11 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- Sunburn, skin damage, or health effects from tanning based on app recommendations
- Loss of data or session history
- Inaccurate UV index or weather readings
- Service interruptions or downtime
Our total liability to you for any claim shall not exceed the greater of (a) the total amount you paid to Tanly in the 12 months prior to the event, or (b) $50 USD.
12 Indemnification
You agree to defend, indemnify, and hold harmless Tanly and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
13 Termination
We may suspend or terminate your account at any time, without prior notice, for violations of these Terms or for any other reason at our discretion.
You may delete your account at any time through the app's Settings screen or by contacting us at support@tanly.co. Upon account deletion, your session history and personal data will be permanently removed from our systems within 30 days, subject to legal retention requirements.
Sections covering intellectual property, disclaimers, limitation of liability, and governing law will survive termination.
14 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Delaware.
15 Changes to Terms
We may update these Terms at any time. Significant changes will be communicated via in-app notification or email (sent via Resend) with the updated effective date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
